Estudo sobre a transparência regulatória na América Latina: um olhar para as informações disponibilizadas nos websites das agências regulatórias

O ritmo acelerado do desenvolvimento, produção e fornecimento de novos produtos na
área da saúde, geram regulações cada vez mais complexas, desafiando o trabalho das
autoridades de saúde. Tendo em vista a importância do trabalho desses órgãos para que sejam
disponibilizados no mercado apenas produtos com eficácia, qualidade e segurança, é de suma
importância que as agências adotem as boas práticas regulatórias. A transparência é uma das
características elencadas pelas boas práticas, além disso, ela é um ponto chave para o bom
funcionamento regulatório, uma vez que ela pode influenciar na adoção de diretrizes pelos
pacientes, fabricantes e até mesmo na economia desse setor. Desta forma, o principal objetivo
deste trabalho foi analisar e discutir a transparência dos websites das agências regulatórias da
região da América Latina, através do nível de informação compartilhado, por meio dos critérios
estabelecidos na metodologia do estudo. Dentre as agências dos países analisados e
considerando os critérios estabelecidos pelo estudo (um total de 19), o website da agência do
Brasil (ANVISA) é o único que possui todos os 19 critérios elencados. O website da agência
da Argentina (ANMAT) e do Equador (ARCSA) apesar de não apresentarem todos os critérios,
possuem uma boa quantidade deles, totalizando 14 critérios dos 19. Assim, ao comparar os
dados obtidos, é possível visualizar que existem divergentes níveis de transparência praticados
nos websites das agências regulatórias da região, e que existem oportunidades de melhorias.
The fast pace of development, production, and supply of new products in the healthcare sector is leading to increasingly complex regulations, posing challenges to the work of health authorities. Considering the significance of their role in ensuring that only products with effectiveness, quality, and safety are made available in the market, it is of paramount importance for regulatory agencies to adopt good regulatory practices. Transparency is one of the key aspects emphasized by these good practices. Furthermore, it is a critical element for the proper functioning of regulation, as it can influence the adoption of guidelines by patients, manufacturers, and even the economic aspects of this sector. Therefore, the main objective of this work was to analyze and discuss the transparency of the websites of regulatory agencies in the Latin American region, through the level of information shared, through the criteria established in the study methodology. Among the agencies in the analyzed countries and in consideration of the criteria set forth in the study (a total of 19), the website of the Brazilian agency (ANVISA) is the only one that meets all 19 criteria. The websites of the Argentinian agency (ANMAT) and the Ecuadorian agency (ARCSA), although not meeting all the criteria, have a substantial number of them, totaling 14 out of the 19. Thus, when comparing the data obtained, it is possible to see that there are divergent levels of transparency practiced on the websites of regulatory agencies in the region, and that there are opportunities for improvement.
