Cada vez mais indivíduos têm recorrido ao Poder Judiciário em busca de insumos hospitalares e tratamentos para feridas, deslocando questões de saúde para os tribunais e gerando debates sobre o papel do Judiciário na garantia de serviços médicos. Objetivo geral: Analisar a judicialização do acesso a curativos e bandagens para o Tratamento de Feridas no Brasil e no Estado de São Paulo. Objetivos específicos: Caracterizar as demandas judiciais relacionadas ao fornecimento de curativos e bandagens para o tratamento de feridas no Brasil e descrever as demandas judiciais em primeiro e segundo grau de Jurisdição, impetradas junto ao Tribunal de Justiça de São Paulo (TJSP) relacionadas ao fornecimento de curativos e bandagens para o tratamento de feridas. Método: estudo com abordagem quali-quanti, descritivo e interpretativo. Dados extraídos no sitio eletrônico do Painel de Estatísticas Processuais de Direito da Saúde e em Sentenças e Acórdãos com trânsito em julgado no Tribunal de Justiça do Estado de São Paulo (TJSP), no período de 2020 a 2023. Resultados: a maioria dos processos judiciais que buscam garantir a eficácia das políticas públicas de saúde se refere à proteção de direitos já incluídos no SUS. O tempo de tramitação dos processos judiciais na área da saúde desempenha um papel crítico na eficácia da judicialização, influenciando diretamente o acesso dos indivíduos a tratamentos e serviços de saúde. As demandas judiciais analisadas envolvem itens que, para o Estado, não acarretariam desequilíbrio financeiro. Conclusão: A judicialização configura um canal essencial para acessar o direito social à saúde, demonstrando que não se trata de uma invasão à competência dos demais Poderes da República, mas sim uma resposta legítima diante das deficiências no sistema de saúde. Recomendamos o desenvolvimento de estratégias para a garantia do acesso aos recursos para o tratamento de feridas de forma equitativa através da rede de atenção.
More and more individuals have turned to the Judiciary in search of hospital supplies and treatments for wounds, shifting health issues to the courts and generating debates about the role of the Judiciary in guaranteeing medical services. General objective: To analyze the judicialization of access to dressings and bandages for Wound Treatment in Brazil and the State of São Paulo. Specific objectives: Characterize the legal demands related to the supply of dressings and bandages for the treatment of wounds in Brazil and describe the legal demands in the first and second degree of Jurisdiction, filed with the Court of Justice of São Paulo (TJSP) related to the supply of dressings and bandages for treating wounds. Method: study with a quali-quanti, descriptive and interpretative approach. Data extracted from the website of the Health Law Procedural Statistics Panel and in Sentences and Judgments that have become final and unappealable at the Court of Justice of the State of São Paulo (TJSP), in the period from 2020 to 2023. Results: the majority of legal proceedings that seek to guarantee the effectiveness of public health policies refers to the protection of rights already included in the SUS. The processing time of legal proceedings in the health sector plays a critical role in the effectiveness of judicialization, directly influencing individuals' access to health treatments and services. The legal demands analyzed involve items that, for the State, would not cause financial imbalance. Conclusion: Judicialization constitutes an essential channel for accessing the social right to health, demonstrating that it is not na invasion of the competence of the other Powers of the Republic, but rather a legitimate response to deficiencies in the health system. We recommend developing strategies to ensure access to resources for wound care in an equitable manner across the care network.
