    O eclipse do conceito nos limites da teoria do crime e da punição retributiva na filosofia do direito de G.W. F. Hegel (1821)

    This dissertation investigates the limits of Hegelian legal thought, 7lemento in the Philosophy of Law of 1821. Through a methodological path, which recognizes the experience of conscience, the fundamental 7lemento of the articulation between law, history and culture, a possibility of a new interpretation of the social function of law, according to the metric of the objective Spirit and the reallocation of the ontological priority of the essence. The reinsertion of legal practices in the domain of reflective determinations of conscience (na axial concept in both the Phenomenology of the Spirit and the Doctrine of the Essence) allows the fundamental categories of law in Hegel, such as personal personalities, property, contract, crime and punishment, to be observed as concepts in perennial construction.

    This Work Aims To Demystify Hegel's Theory And Present The Concrete Foundation Of Speculative Thought. It Is Analyzed Here Not As Mere Thinking, But As An Effective Unfolding Of The Contradiction Which Is Its Condition Of Existence. It Begins With The Living Being With Its Dialectic Between Body And Abstraction (Life), And After Deals With The Development Of Perception And Then Enters Into The Analysis Of The Understanding Operating As A System Of Linguistic Value. Finally We Will See These Forms In Action In The Early Social Structures. Dividing These Moments It Becomes Possible To Isolate Aspects Of Hegel's Theory And To Compare Them With Central Developments Of Specific Theories Of Each Of These Areas (Mainly Of Aristotle, Marx, Saussure, Jakobson, Lacan, Freud, Mauss, Durkheim And Lévi-Strauss). It Makes It Easier Not Only To Dispel The Accusations Of Mysticism But Also To Glimpse How Hegel's Thought Could Anticipate So Many Aspects Of Later Theories.

    A Prosa Do Mundo E A Poesia Do Coração: Aspectos Do Legado Hegeliano Na Teoria Do Romance De Lukács

    The goal of this work is to present the Theory of the Novel from Georg Lukács under the lights of the classical poetry of genders and, in particular, the influence of the Hegelian legacy on the esthetics formation of the Hungarian philosopher, highlighting the main idea of the novel such as proposed by Georg Wilhelm Friedrich Hegel: namely, the collision among the social relations prose (the prose of the world) and the poetry of the heart. Both authors conceive the novel as the epopee from the modern era, though they diverge in the historical-philosophical meaning of this esthetical situation. For this purpose, it is presented the foundations of the traditional aesthetics and its inversion from the dialectical movement in what Hegel put the classical poetry of gender from an Aristotelian basis through. After that, the work moves to the body of the text of the Theory of the Novel, recomposing the arguments from the author under the lights of the esthetical philosophy and the “science of the spirits” from Hegel, since its esthetical convergence until the divergence of social nature among the authors, about the meaning of the novel as a literary experience from modernity, especially the theme of the reconciliation or the no reconciliationof the poetry of the heart with the prose of the world. Finally, the work of the German poet, Johann Wolfgang Von Goethe, Wilhelm Meister’s Apprenticeship (Wilhelm Meisters Lehrjahre), is used as a significant literary representation to express the content and the meaning of the novel, being either about the whole of the gender and the essential division that gives rises to it, or as a particular development, the novel of German formation (Bildungsroman), typical from the end of the XVIII century.
