Resumo
A pesquisa tem como intuito analisar o caso dos empregados da fábrica de fogos de “Santo
Antônio de Jesus e seus familiares vs. Brasil”, no qual o Estado brasileiro foi condenado pela
Corte Interamericana dos Direitos Humanos pela prática de violações de direitos humanos,
mais especificamente, dos direitos à vida e à integridade, devido a negligência às más
condições de trabalho oferecidas pela fábrica, resultando na explosão e na morte de grande
parte de seus empregados. Para entender melhor o caso, abordaremos as seguintes questões: O
Estado brasileiro de fato feriu os direitos à vida e à integridade conforme alega a Corte
Interamericana? Quais acusações foram aceitas para determinação da sentença? A pena foi
cumprida em sua integridade? Quais efeitos tiveram a sentença do caso no âmbito doméstico
ligado a Direitos Humanos e Empresas? Os planos de ação proferidos, foram cumpridos em
sua totalidade? Dada a frequência nos casos de violações empresariais contra os direitos
humanos nas últimas décadas e, não havendo uma norma internacional de direitos humanos
vinculante para empresas, salvos princípios e acordos, o trabalho visa analisar quais foram as
implicações deste caso, em termos comparativos entre a jurisdição doméstica e internacional,
e, se houve, de fato, o cumprimento da sentença apresentada pela Corte Interamericana.
Também serão avaliadas quais eram as condições do local do acidente para investigar e
validar se realmente houve a ausência de fiscalização por parte do Estado, e, finalmente
entender o porquê da necessidade de entrada de um tribunal regional para tratar de assuntos
que envolvem o descumprimento de um acordo no qual o Brasil é signatário.
The research aims to analyze the case of employees of the fireworks factory of “Santo Antônio de Jesus and his family members vs. Brazil”, in which the Brazilian State was condemned by the Inter-American Court of Human Rights for the practice of respect for human rights, more specifically, the rights to life and integrity, due to negligence of the poorer working conditions offered by the factory, caused by the explosion and the death of a large part of its employees. In order to better understand the case, we will address the following questions: Did the Brazilian State in fact violate the rights to life and integrity as established by the Inter-American Court? Which ones were accepted for the sentencing experience? Was the feather designed in its integrity? What effects did the judgment of the case have on the domestic sphere linked to Human Rights and Business? Have the issued action plans been fully complied with? Given the frequency in cases of respecting human rights in recent decades and, since there is no international human rights standard binding on companies, except for principles and agreements, the work aims to analyze what were the instructions in this case, in comparative terms between the domestic jurisdiction international level, and whether, in fact, the judgment was complied with by the Inter-American Court. The conditions of the accident site will also be evaluated in order to investigate and validate whether there really was a lack of supervision by the State, and, finally, to understand the reason for the need for a regional court to enter to deal with matters involving non-compliance with an agreement to which Brazil is a signatory
