Resumo
O presente trabalho tem como objetivo analisar o Caso Gomes Lund e Outros (“Guerrilha do Araguaia”) vs. Brasil. A pesquisa tem foco no cumprimento da sentença da Corte Interamericana, no que diz respeito à determinação de busca, localização e identificação das pessoas desaparecidas. As perguntas que norteiam esse trabalho são: “O que foi decidido pela Corte no que se refere à obrigação de localizar os restos mortais dos desaparecidos? Quais foram as ações tomadas pelo Estado brasileiro em resposta a essas determinações da Corte? Essas determinações foram totalmente cumpridas?”. E as hipóteses consideradas são de que o Estado brasileiro teria atrasado o cumprimento das determinações da Corte, e de que o Brasil não tenha cumprido totalmente as determinações. Para a pesquisa, foram utilizados como fonte documentos, bibliografia especializada, matérias jornalísticas e uma audiência pública promovida pela Corte Interamericana, a respeito do cumprimento da sentença. Primeiro, são apresentados os parâmetros e conceitos de direito internacional importantes para o estudo; em segundo lugar, apresenta-se o que foi a Guerrilha do Araguaia, a repressão militar, a denúncia internacional do caso e as determinações da sentença que condenaram o Estado brasileiro; em terceiro lugar sistematizam-se as ações do Estado para o cumprimento da sentença, com foco na determinação de busca e localização dos desaparecidos. A pesquisa concluiu, portanto, que, mesmo com os esforços feitos pelo Estado brasileiro, a medida de reparação analisada não deve ser considerada cumprida, visto que os objetivos não foram atingidos e não foram esgotadas todas as possibilidades possíveis para alcançar esse objetivo, devendo o Estado então continuar com as ações de busca, localização e identificação.
The present work aims to analyze the case of Gomes Lund and Others (“Guerrilha do Araguaia”) vs. Brazil, with a focus of research on compliance with the Inter-American Court's judgment regarding determining the search, location, and identification of missing persons. The questions that guide this work are: “What has been decided by the Court regarding the obligation to locate the remains of the disappeared? What were the actions taken by the Brazilian State in response to these determinations of the Court? Have these determinations been fully complied with?”. And the hypotheses considered are that the Brazilian State would have delayed compliance with the Court's determinations, and that Brazil has not fully complied with the determinations. For the research, documents, specialized bibliography, journalistic materials, and a public hearing promoted by the Inter-American Court regarding compliance with the sentence were used as sources. First, the parameters and concepts of international law that are important for the study are presented; secondly, it presents what was the Guerrilha do Araguaia, the military repression, the international denunciation of the case and the determinations of the sentence that condemned the Brazilian State; third, the State's actions to comply with the sentence are systematized, with a focus on determining the search and location of the disappeared. The research therefore concluded that, even with the efforts made by the Brazilian State, the reparation measure analyzed should not be considered fulfilled, since the objectives were not achieved and all possible possibilities to achieve this objective were not exhausted, and the State must then continue with the actions of search, location, and identification.
