Resumo
A presente pesquisa visou compreender e analisar o processo sócio-histórico da
evolução dos direitos das crianças e dos adolescentes, destacando o papel do
Conselho Tutelar na sociedade como agente para a garantia de direitos das crianças
e adolescentes. O estudo tem como objetivo entender a dinâmica de trabalho das/os
conselheiras/os tutelares no espaço de sua atuação social, analisando o seu
cotidiano, suas dificuldades e desafios, além de refletir como o Conselho Tutelar é
descrito a partir do Estatuto da Criança e do Adolescente. O estudo fundamentado em
pesquisa bibliográfica, de caráter exploratório, sendo inicialmente pesquisado sobre a
evolução do direito infanto-juvenil no Brasil, tendo como referência estudos sobre a
criança e do adolescente em séculos passados e a evolução dos direitos. Em seguida,
a pesquisa buscou analisar os impactos das lutas e mobilizações sociais realizadas
em prol da garantia de direitos das crianças e dos adolescentes, com relevância ao
Movimento Nacional de Meninos e Meninas de Rua (MCMMR) e analisamos o
Estatuto da Criança e do Adolescente e a diretrizes para a constituição do Conselho
Tutelar. Por fim, a pesquisa buscou compreender a atuação do Conselho Tutelar frente
a vulnerabilidade da criança e do adolescente, e suas principais atribuições e deveres
junto ao Sistema de Garantia de Direitos, assim como suas dificuldades e desafios no
cotidiano de atuação. A luta política foi fundamental na trajetória da conquista dos
direitos das crianças e adolescentes e foi intensa, podendo ser observado que havia
necessidade social de garantir a proteção imediata à infância e adolescência.
Proteção que ainda é um caminho a ser trilhado, mesmo com o Estatuto da Criança e
do Adolescente, as violações cotidianas que sofrem crianças e adolescentes
persistem de forma grave no Brasil e a atuação da/o Conselheira/o Tutelar torna-se
cada vez mais necessária frente à essa realidade que os desafia na garantia dos
direitos da criança e do adolescente. Fortalecer e responsabilizar o Sistema de
Garantia dos Direitos torna-se necessário.
This research aims to understand and analyze the socio-historical process of the evolution of the rights of children and adolescents, highlighting the role of the Guardianship Council in society as an agent for guaranteeing the rights of children and adolescents. The study aims to understand the work dynamics of guardianship counselors in the space of their social activity, analyzing their daily lives, their difficulties and challenges, in addition to reflecting on how the Guardianship Council is described based on the Child Statute and of the Teenager. The study is based on bibliographical research, of an exploratory nature, initially being researched on the evolution of children's rights in Brazil, with reference to studies on children and adolescents in past centuries and the evolution of rights. Next, the research sought to analyze the impacts of struggles and social mobilizations carried out in favor of guaranteeing the rights of children and adolescents, with relevance to the National Movement of Street Boys and Girls (MCMMR) and analyzed the Child and Adolescent Statute and guidelines for the constitution of the Guardianship Council. Finally, the research sought to understand the role of the Guardianship Council in relation to the vulnerability of children and adolescents, and its main attributions and duties within the Rights Guarantee System, as well as its difficulties and challenges in its daily activities. The political struggle was fundamental in the achievement of the rights of children and adolescents and was intense, and it can be seen that there was a social need to guarantee immediate protection for children and adolescents. Protection that is still a path to be taken, even with the Statute of Children and Adolescents, the daily visible that victims of children and adolescents persist in a serious way in Brazil and the role of the Guardian Counselor becomes each increasingly necessary in the face of this reality that challenges the guarantee of the rights of children and adolescents. Strengthening and making the Rights Guarantee System accountable becomes necessary.
