O Compliance é um setor fundamental para a Indústria Farmacêutica. O termo surgiu há várias
décadas atrás e, com o passar dos anos, foi ganhando importância em pequenas, médias e
grandes empresas. O Compliance ganhou força, inicialmente, nos Estados Unidos e aos poucos
foi se expandindo para outras regiões. No Brasil, estar em conformidade ganhou uma grande
notoriedade com o escândalo da Petrobrás e, principalmente, com a promulgação da Legislação
Anticorrupção Brasileira (2013). Para realização deste trabalho foram utilizadas três bases de
dados diferentes e 14 artigos foram selecionados em um período entre 2005 e 2022. Além
destes, também foram selecionados outros correlacionados ao tema, bem como consultas de
legislações e regulamentações. Sendo assim, este trabalho estudou o Compliance na Indústria
Farmacêutica e as interações com os Profissionais de Saúde. Dentre os vários requisitos e
especificações exigidas em um sistema de Compliance, ter um Código de Conduta dentro da
companhia é fundamental para que todos os funcionários e membros da empresa sejam guiados
por uma bússola. Os Códigos das Associações de Classe também corroboram para a
regulamentação do setor. Este sistema contribui para as Boas Práticas de uma empresa, e está
baseado em 3 pilares fundamentais: prevenção, detecção e correção. Dentro de cada pilar, uma
série de medidas são adotadas como: comunicações, treinamentos, monitoramentos,
investigações, auditorias, planos de mitigação, dentre outros. No ramo farmacêutico, as
indústrias possuem uma grande preocupação em regulamentar preços, marketing, presentes
oferecidos a Profissionais de Saúde e etc. Garantir que uma empresa tenha condutas éticas, de
acordo com as leis de um país, evita que a mesma seja punida e assegura credibilidade no
mercado. Atualmente, ter um setor de Compliance é imprescindível para a Indústria, além de
ser uma área que tende a crescer e se expandir ainda mais nas próximas décadas.
Compliance is a key sector for the Pharmaceutical Industry. The term appeared several decades ago and, over the years, has gained importance in small, medium, and large companies. Compliance initially gained strength in the United States and gradually expanded to other regions. In Brazil, being compliant gained great notoriety with the Petrobras scandal and mainly with the enactment of the Brazilian AntiCorruption Legislation (2013). Three different databases were used to carry out the study, and 14 articles were selected from a period between 2005 and 2022. Besides these, others related to the theme were also selected, as well as consultations on legislation and regulations. Thus, this research studied Compliance in the Pharmaceutical Industry and the interactions with Health Care Professionals. Among the various requirements and specifications demanded in a Compliance system, having a Code of Conduct within the company is fundamental so that all employees and members of the company to be guided by a compass. The Codes of the Class Associations also corroborate for the regulation of the sector. This system contributes to a company's Good Practices, and is based on three fundamental pillars: prevention, detection, and correction. Within each pillar, a series of measures are adopted such as: communications, training, monitoring, investigations, audits, mitigation plans, among others. In the pharmaceutical industry, the industries have a great concern in regulating prices, marketing, gifts offered to Health Care Professionals, etc. Ensuring that a company has ethical conduct, in accordance with the laws of a country, prevents it from being punished and ensures credibility in the market. Nowadays, having a Compliance sector is essential for the Industry, besides being an area that tends to grow and expand even more in the next decades.
