A Eficácia do Regime Internacional dos Direitos Humanos: Tratados e Instituições Internacionais sob a ótica da Interdependência Complexa

Abstract

A presente pesquisa possui por escopo analisar a relação entre as Relações Internacionais e os Direitos Humanos e promover uma reflexão quanto a eficácia do regime internacional dos Direitos Humanos e a possível necessidade de reforma deste sistema. Para alcançar este objetivo, serão abordados os conceitos de Interdependência Complexa sob a ótica de Keohane e Nye, além do conceito de Direitos Humanos e Direitos fundamentais sob a ótica da dignidade da pessoa humana, bem como dimensões e respectivas previsões normativas no ordenamento internacional, isto é, versará também acerca dos tratados internacionais no que tange sua aplicabilidade. Em seguida, apresentar-se-á a estrutura dos Sistemas Internacionais de Proteção aos Direitos Humanos a nível global e regional. Para análisar a eficácia dos Direitos Humanos será apresentado brevemente o debate entre as teorias neorrealista e neo institucionalista e, por fim, um caso prático do Sistema Interamericano de Direitos Humanos condenado pela Corte Interamericana.

The purpose of this research is to analyze the relationship between International Relations and Human Rights and to promote a reflection on the effectiveness of the international human rights regime and the possible need for reform of this system. To achieve this objective, the concepts of Complex Interdependence from the perspective of Keohane and Nye will be addressed, in addition to the concept of Human Rights and Fundamental Rights from the perspective of human dignity, as well as dimensions and respective normative provisions in the international order, that is, that is, it will also deal with international treaties in terms of their applicability. Then, the structure of the International Systems for the Protection of Human Rights at global and regional levels will be presented. In order to analyze the effectiveness of Human Rights, the debate between neorealist and neo-institutionalist theories will be briefly presented and, finally, a practical case of the Inter-American System of Human Rights condemned by the InterAmerican Court.
