- ItemAcesso aberto (Open Access)Gestão de propriedade intelectual: patentes e softwares(Universidade Federal de São Paulo (UNIFESP), 2021) Keder, Michel Delgado [UNIFESP]; Graziosi, Maria Elisabete Salvador [UNIFESP]; Universidade Federal de São PauloIntroduction: the adoption of administrative procedures by the Center for Technological Innovation at the Federal University of São Paulo, necessary for the effective management of intellectual property, such as patents and software, is essential in order to meet the technical and scientific requirements required for this academic activity of institution. Such procedures must be fundamentally quick, strategic and legally safe for the institution and researchers, observing the principles of legality, transparency and efficiency. Objectives: to legally base the existing flows in the Technological Innovation Center, as well as describe and propose new flows and changes to internal procedures. Method: this is a descriptive, documentary, exploratory study with a qualitative approach. This study was developed at the Technological Innovation Center of the aforementioned institution and has the following methodological steps: compilation of legislation on protection and management of intellectual property, federal laws and institution internal rules; research of books and other publications containing interpretations about the rules of protection and management of intellectual property; research on courses on protection and management of intellectual property; participation in advanced courses of the World Intellectual Property Organization on protection and management of intellectual property; identification and study of the competencies of the Technological Innovation Center according to federal legislation and internal rules of the institution; detailed study about the internal regulations of the Technological Innovation Center of the institution; analysis of the factual reality of the Center for Technological Innovation at the institution; research and analysis of the internal rules of other public universities recognized for excellence in the management of their intellectual property. Results: We describe all the administrative procedures (flows) currently existing at Center, from the receipt of the invention notice form to the grant of the patent or free assignment of rights to the inventor himself. We have compiled the essential rules for the protection and management of intellectual property. We legally justify the main procedures carried out by Center. We suggest changes to flows that seem to be in disagreement with the law or for which we have found no legal basis. And we prepared a manual describing and explaining the intellectualproperty management procedures carried out by Center and mentioning the laws on which they are based. Conclusion: the management of intellectual property must be efficient for the development of the country, minimizing violation of principles of Public Administration in order to promote scientific activities of researchers and interests of the owner of intellectual property, preserving intellectual efforts and invested financial resources.

A Lei Básica de C&T japonesa (1995) estabeleceu medidas para fortalecer a pesquisa colaborativa entre universidade e indústria e reformas institucionais em universidades nacionais e laboratórios de pesquisa, além de aumentar o orçamento destinado à C&T. Na economia baseada no conhecimento, a transferência de tecnologia nas universidades são elementos-chave para a inovação. O processo de transferência de tecnologia universidade-indústria (TTU-I) é complexo e muitos trabalhos recentes procuram compreender os fatores que afetam o desempenho da TTU-I e estabelecer métricas que auxiliem a avaliação dos resultados do processo. O objetivo do estudo foi avaliar a eficiência da TTU-I no Japão em relação a alocação de recursos científicos e técnicos. A eficiência técnica de 61 Universidades Nacionais do Japão foram estimadas pela Análise de Fronteira Estocástica (Stochastic Frontier Analysis - SFA). O processo de transferência de tecnologia proposto considerou o número de pedidos de patentes (PAPL) em função do financiamento de pesquisa (FINP), da equipe de pesquisa (STAF), do número de licenças em execução (LEXE) e da receita do licenciamento de patentes (LREC). A Universidade de Agricultura e Tecnologia de Tóquio no ano de 2017 foi a instituição com o maior índice de eficiência. Os resultados sugerem que a ineficiência técnica persistente é um problema maior do que a ineficiência técnica residual na transferência de tecnologia universidade-indústria no Japão.
